Duterte won’t allow ABS-CBN to operate whatever it takes? This is the strong stand of the President regarding the grand issue on Kapamilya Network even congress would grant another fresh 25 years franchise..

Let’s look on the grounds!

Philippine President Rodrigo Duterte’s anger at the Lopez family flared yet again as he declared he would not recognize any franchise granted by Congress to broadcasting network ABS-CBN.

The network went off the air in May 2020 after its legislative franchise expired.

In September of the same year, the NTC issued an order recalling all frequencies or channels assigned to the media company.

“Congress is planning to restore the franchise of the Lopezes, wala akong problema doon, kung i-restore ninyo (I have no problem if you restore it), but if you say they can operate… I will not allow it,” Duterte said on Monday, February 8, in a meeting about the COVID-19 pandemic.

Last month, Senate President Vicente Sotto III filed a bill seeking to renew ABS-CBN’s franchise.

Batangas 6th District Rep. Vilma Santos-Recto filed a similar measure in the lower chamber.

“I will not allow the NTC (National Telecommunications Commission) to grant them the permit to operate,” he continued.

Last month, Duterte made a similar rant but did not name the Lopezes or ABS-CBN.

Legislative branch vs executive branch.

The legislative branch – the House of Representatives and Senate – has the power to ratify bills granting franchises to broadcasting firms.

But the President signs these franchise bills into law, vetoes them, or allows them to lapse into law.

Though Duterte has the power to veto any franchise for ABS-CBN or the Lopez Group of Companies, the President instead said he would oppose such a franchise by simply not implementing the law granting the franchise.

The NTC, which regulates and monitors franchises for broadcast frequencies, is under the executive branch headed by the President.

“I will ignore your franchise and I will not give them the license to operate,” said Duterte.

He likened granting the Lopezes a franchise to “giving them a prize for committing criminal acts.”

He repeated allegations that the Lopezes unjustly benefited when the state-owned Development Bank of the Philippines condoned P1.6 billion worth of loans in 2006.

Such a claim was the subject of a House committee hearing on January 18, amid new efforts by lawmakers to give ABS-CBN a fresh franchise. Allowing the network to operate without payment of taxes, he said, would be nonsense“kalokohan.”

“It’s like you gave them a prize for committing a crime,” he said.

Inflation is expected to quicken to as fast as 5.1% in February amid rising fuel and food prices, Philippine central bank Governor Benjamin E. Diokno said on Friday.

The Bangko Sentral ng Pilipinas (BSP) expects the consumer price index at 4.3% to 5.1%, beyond its 2-4% target this year and faster than 4.2% in January.

“Upward price pressure for the month emanate from the continued uptick in global crude oil prices and elevated fish prices,” Mr. Diokno told reporters in a Viber group message.

At home, gasoline, kerosene and diesel prices have increased by P3.05, P2.90 and P3.30 this month, based on data from the Department of Energy.

Meanwhile, the open fishing season and lifting of the fishing ban in some parts of the country are expected to bring down fish prices especially of household staples such as round scad or galunggong.

Mr. Diokno said lower power rates and the temporary price caps on meat products in Metro Manila, as well as stable rice prices could somehow pull inflation this month.

The government imposed a 60-day price ceiling on some pork and chicken products and boosted pork imports to counter soaring prices caused by an African Swine Fever outbreak.

Some vendors have chosen not to sell these products. Data from the Philippine Statistics Authority showed the average wholesale price of regular milled rice slipped by 0.1% to P33.31, while the retail price was down by 0.03% to P36.14.

Manila Electric Co. this month said electricity bills of typical households might fall by P14 in February.

The central bank kept the overnight reverse repurchase, lending and deposit rates at 2%, 2.5%, and 1.5%, respectively on Feb. 11 after inflation quickened to a two-year high last month.

Last year, it slashed rates by 200 basis points. The Monetary Board will hold its next policy-setting meeting on Mar. 25.

Called the Payments and Currency Management Sector, the new unit will be headed by newly appointed Deputy Governor Mamerto Tangonan who recently joined the central bank with a background in digital and inclusive finance services.

“[The new sector] is tasked to maintain the safety and integrity of the local currency and to ensure well-functioning payments and cash ecosystem that supports sustained and inclusive economic growth,” BSP Governor Benjamin Diokno said.

“This is aligned with the BSP’s Digital Payments Transformation Roadmap which aims to achieve efficient, safe, and inclusive payments ecosystems,” he added during an online briefing on Wednesday afternoon.

The new sector, which consolidates existing currency and payment management units, is responsible for producing banknotes, coins, and securities documents; refining gold; and printing cards for the national ID.

It is also in charge of anti-counterfeiting operations; currency forecasting; currency retirement; and the servicing of bank deposits and withdrawals in the greater Manila area. Cash operations in the regions will continue to be performed by regional offices and branches.

The new department will also handle the licensing and supervision of payment system operators; formulation of strategies and policies for currency and payments systems, including the digital payments transformation and currency forecasting; operations of the Philippine Payment and Settlement System; and administration of the digital Personal Equity Retirement Account.

The new deputy governor brings with him over 28 years of experience in digital and traditional financial services, telecommunications, technology, financial inclusion, and consulting services.

Immediately before joining BSP, Tangonan led a six-year USAID-funded program on the E-PESO project aimed at accelerating the shift of the Philippine economy from cash to digital payments.

In this capacity, he spearheaded a team in providing technical assistance to the BSP in the policy formulation and implementation of the National Retail Payments System.

Lawyer Mike Santiago, who represents 11 respondents, said in a Thursday, March 4, press briefing that their camp received the day before from the Makati police a copy of a motion to reopen the case and admit additional evidence.

“And now that everybody is waiting, eagerly waiting for the release of the resolution on the preliminary investigation, they would want the investigation to be reopened? Not on the basis of newly discovered evidence, but on the basis of old evidence that is being presented only now,” Santiago said.

According to a toxicology report dated February 11 illegal drugs fluoromethamphetamine and methamphetamine were allegedly found in the crime scene. Meanwhile, a medico-legal report dated February 9 says semen was found in the retrieved specimen.

“The Makati City prosecutor’s office, however, had already closed the 5th and last preliminary investigation on February 17.”

“So how come they are just submitting this alleged chemistry report today or yesterday, when in fact this has been available as early as February 11, 2021?” Santiago asked. 

“It raises a lot of doubts. Not only doubts, it raises also fear among the respondents, among us, among our camp. What’s being cooked behind all of this?” he added.

In a phone interview, lawyer Brick Reyes, counsel of the Dacera family, said the additional evidence supports their theory of rape with homicide. 

“[This information retrieved by PNP should be added] to the investigation of [the] City Prosecutor of Makati because this is a very serious finding. With these findings, we now have supporting evidence for rape with homicide [and] violation of the dangerous drugs law,” said Reyes.
